Welcome to the Terms and Conditions of Flatastic.
The Flatastic application is an application to manage your household (hereinafter “application”, “service”, “website”) provided by Flatastic GmbH based in Zurich, Switzerland (“Flatastic”, “we”, “us”, “our”). You can reach us at admin@flatastic-app.com.
The Terms and Conditions regulate the contractual relationship between Flatastic and the person using our application or other offerings (“User”). By using the application etc. the User confirms to have read and understood these Terms and Conditions and agrees to them.
If you do not agree, please do not use the application and other offerings.
The application consists of different modules such as but not limited to a shared shopping list, expenses management system, cleaning schedule, chat functionality, contract and subscription management systems.
The application is a work in progress and may be changed, extended, shut down or restricted at any time by Flatastic (without giving reasons and without prior notice).
The application (if available) is provided "as is" and without any warranties. In particular, Flatastic does not guarantee the availability or the functioning of the application. The User is at all times responsible for her own contract and subscription management and must not rely on the information provided by the application (such as cancellation or payment deadlines).
The application can be used free of charge. With a paid subscription or in-app purchase, users can unlock additional features and functionalities, such as, but not limited to, reduced advertising, additional storage, statistics, image upload, filtering and editing options. Purchases are subject to the terms and conditions as described in the respective App Stores.
Besides the infrastructure made available and maintained by Flatastic, Flatastic uses the Apple App Store and the Google Play Store to distribute the application and for the billing of in-app purchases. The User confirms that he or she is authorized to use the application. In particular, the User is older than 13 years and is capable of making judgments regarding (the use of) the application.
By agreeing to these terms and conditions, the User confirms that these requirements are met.
Flatastic may exclude the user from the use of the application at any time without notice and without giving reasons.
The User agrees to use the application solely for its intended purpose and to comply with all applicable laws in his or her jurisdiction. In particular, the User undertakes not to use the application for illegal or fraudulent activities. The User is responsible for preventing unauthorized access to their account.
The User grants Flatastic a royalty-free, sublicensable, non-exclusive and worldwide license to use all content generated by the User, which is subject to intellectual property rights.
The application enables the User to share payments within their household or group with no explicit permissions or rules. The information entered by the User is used by the application to calculate debts between the members of this group. These calculated debts are not legally binding, but are informal records. Flatastic cannot guarantee that payments have been correctly entered into the application by the User or that debts will be correctly calculated by the application.
In general, records created by the User in the application, such as expenses, finances, bills, debts, payment receipts and purchases, are informal records and not legally binding contracts.
Flatastic may enable the User to purchase services, contracts and goods to enhance live at home directly from selected Service Providers. In this case, the contract is concluded directly between the Service Providers and the User and the Terms and Conditions including the Privacy Policy of the Service Provider may govern the contract. Flatastic acts as an intermediary only and does not become a party to the contract between the Service Providers and the User.
The collection and usage of personal data is described in the Privacy Policy. By using the application, the User confirms to be aware of and to agree with the Privacy Policy.
Flatastic displays advertising in certain areas of the application. The advertising is marked as such. Flatastic may obtain the content from a third party provider. Besides adjusting the categories and settings, Flatastic has no influence on the displayed content nor can it be held responsible for the displayed content.
As an Amazon Associate Flatastic earns from qualifying purchases.
Under no circumstances will Flatastic be liable for any direct or indirect damages arising out of or in connection with the use of the application.
Liability for slight negligence is hereby explicitly excluded.
The application is provided as is (if available) and without any warranty. Flatastic disclaims any warranty for availability and operability of the application.
The User agrees that Flatastic may modify this agreement at any time, effective upon a suitable information of the User. By continuing to use the application after the notification of changes of the terms and conditions, the User expressly agrees to them.
Swiss law is applicable to all claims of the User (and of Flatastic) in connection with the application or other services provided by Flatastic. The state courts in Zurich (Switzerland) have exclusive jurisdiction for disputes.
